NEW YORK (AP) — Luigi Mangione spoke out in court Friday against the prospect of back-to-back trials over the killing of UnitedHealthcare CEO Brian Thompson, telling a judge: “It’s the same trial twice. One plus one is two. Double jeopardy by any commonsense definition.”

Mangione, 27, made the remarks as court officers escorted him out of the courtroom after a judge scheduled his state murder trial to begin June 8, three months before jury selection in his federal case.

Judge Gregory Carro, matter-of-fact in his decision after a lengthy discussion with prosecutors and defense lawyers at the bench, said the state trial could be delayed until Sept 8 if an appeal delays the federal trial.

Mangione’s lawyers objected to the June trial date, telling Carro that at that time, they’ll be consumed with preparing for the federal trial, which involves allegations that Mangione stalked Thompson before killing him.

“Mr. Mangione is being put in an untenable situation,” defense lawyer Karen Friedman Agnifilo said. “This is a tug-of-war between two different prosecution offices.”

“The defense will not be ready on June 8,” she added.

      One is a state charge the other is federal. Welcome to the American “justice” system.

      The state and federal charges are “technically” different crimes.

      The good news in all this is that they are desperate. Also I still maintain he is not The Guy. There is just no fucking way. The chain of evidence, no indication he was disciplined enough to pull it off, the fucking video that shows someone who is very obviously a pro (printed the gun, knew about the cycling issue with a weapon not intended for subsonic recoil, quickness of compensating etc.)

        I alternate between he’s not the guy and he is the guy but he didn’t have the gun or anything silly to have on him, they planted them after using illegal surveillance to find him, then tried to construct a legal narrative for arresting him.

        The video also shows a guy who looks nothing like Luigi wearing totally different clothes and a different backpack to the clothes and backpack they claim to have found that matched.

        Like from the first pictures they showed of Luigi in the hostel, it was like “Cool yeah that’s a guy wearing a coat. A different one than the shooter.”

          What’s even more is that there is a picture of the shooter and then another picture of someone who looks more like Luigi wearing completely different outfits within 15 minutes of each other.

      as I understand it, in the US, the double jeopardy rule applies within a jurisdiction per the federal constitution. Individual states may also choose to create further protections on top of that. Which NY has done. NY state may not try someone after they have already had their federal trial. However as no such prohibition applies at the federal level, they are able to let NY have the first kick at the can, then come in for a second round.

      What I’m not sure of, is if he is found guilty in the the first (NY state), will they still proceed with duplicate charges at the federal level? Or is it only a backup.
